Terms of Services
GENERALBeforehand, please keep in mind that by commissioning me or using my art in any form you automatically agree to these terms of services whether you read it or not, so please read them carefully ! They are here to protect me as the artist and you as the client if need be.These rules were edited on November the 8th, 2023. For older artwork, specific rules given on art descriptions on my DeviantArt or ToyHou.se apply.I DO NOT ALLOW ANY USE OF MY ART FOR AI GENERATION, AI TRAINING AND ANY AI USE, I DO NOT ALLOW MY ART TO BE USED FOR NFT AND ANY BLOCKCHAIN TECHNOLOGY.COPYRIGHTI remain the full owner of any artwork I provide. This means you cannot claim it as your own.As the client, you can share artwork you have commissioned me on your platforms and use it on your RPs as long as I am credited as the original artist/designer (either my DeviantArt, Instagram or Toyhou.se. I am Mydajk on all three platforms).As the artist, I can use any commissioned artwork or design on my social platforms for self promotion. I will of course credit the original designer of your character if need be and you as the owner.You are not allowed to edit, trace, copy any of my artwork or designs in any shape or form. This includes not removing my little signature and not creating breedables inspired from my designs.
YOU ARE NOT ALLOWED TO USE MY ART FOR AI OR NFT, BE IT A COMMISSION OR NOT.You can crop an artwork if you need it as an avatar on Toyhou.se and such though.
You can also change the background’s color using the transparent file I will send you if you want, but you can also ask me and I’ll gladly do it :)Don’t forget to save the files I send you as I often clean my Sta.sh ! If you lose a file do not hesitate to DM me so I can check if I still have it, I delete nothing but hard drives don’t last forever so keep that in mind and take precautions on your side too just in case :)COMMERCIAL USEYou are not allowed to use any of my artwork for commercial use. My designs and illustrations are for personal use only. If you would like to print your artwork, you can do so, again, for personal use only.I DO NOT ALLOW ANY USE OF MY ART FOR AI GENERATION, AI TRAINING AND ANY AI USE, I DO NOT ALLOW MY ART TO BE USED FOR NFT AND ANY BLOCKCHAIN TECHNOLOGY.This applies to me as well, I will not use commissioned artworks for commercial use either, they are for you, the client, only.If you need a commercial license for an illustration, let me know beforehand so we can work on specifics. Keep in mind that a commercial license will have a higher price depending on your project.Specific cases :
Reselling a design : if you bought a design from me and no longer want it, you are allowed to trade it or resell it.
You cannot resell a design for more than what you paid for plus paid commissions. This means if X bought it for 15$ and resold it for 10$, then you Y cannot resell it higher than 10$. If you bought a 40$ commission for him, then you can resell it for 50$ maximum. If you’re unsure, do not hesitate to DM me I’ll gladly help :)
Also, your personal art cannot add monetary value to one of my designs ; though if you drew him a lot over time and would like to increase their value, DM me and maybe we can find a middle ground. This will be very exceptional as I do not allow flipping with my designs (flipping means buy it then draw it twice as an excuse to resell it with a higher price).
On a side note, please don’t forget to check every commissioned artist’s T.O.S. to be sure you can add the price of their respective commissions !
As far as I am concerned, if you commissioned me for a character I didn’t design and would like to resell said design, you can add the price of my commissioned artwork to the final price if the original designer of your character does allow it in their TOS.Breedables : you cannot use any of my designs to make breedables, be it for free or for sale. As said in the Copyright section, I do not allow you, the client, or another artist to take inspiration from my designs. If you want a baby from your horsie, it will fall in the custom section, in my DMs. I will be inflexible on this one, any infringement on this will end you blacklisted.Closed species : I do not allow any of my designs, linearts, artworks to be used for Closed Species be it for free or money. Any infringement on this will also end you blacklisted.SIM Games / Howrse : Please see at the bottom of the page for this specific case.PAYMENTRegarding commissions and characters for sale, I accept payment through PayPal only (Goods and Services). The PayPal fee is on me, the seller, to pay !Please do not send payment before I instruct you to do so, as someone might have claimed before you.
Once payment is sent, I will transfer you the bought files through Sta.sh, ToyHou.se or by mail depending on what you would prefer. I usually send two files, with a colored background and a transparent one.
Tipping is cool but not mandatory ! If you do so, you can add the tip to the design’s value as a thank you :)On refundsI do not refund designs you bought from me.
If I haven’t started your commission and you need to cancel it, I will refund you fully.
If I have started your commission but you still need to cancel it, I will refund you partially depending on how much time I’ve spent on it already. We will sort it out in DM.
If I cannot hold my end and need to cancel your order, I will let you know asap and refund you fully.DEADLINESI will do my best to send your art as fast as possible, though be aware that I work aside from drawing. I should accomplish your commission in the four months after you have paid me.If I find myself needing more time due to exceptional circumstances (health, work,...) I will let you know asap and if you want to cancel your commission, I will refund you fully granted that I haven’t started it.If you have a specific deadline in mind (Christmas, a birthday, etc.) let me know when making your order so we can discuss it and work around it !LINEARTSMy free to use linearts cannot be sold as they’re… free.
You can make designs with them.
You cannot sell adopts made on my free to use linearts. Trading is OK.
You can use them for Howrse.
You don’t have to ask me for permission, though I’d love to see your work if you want to share !My pay to use linearts can be used for designs and adopts.
They cannot be sent on Howrse.Don’t forget to credit me as the original artist :)COMMISSIONSI will start your commission after receiving full payment.
Once sketching is done I will send a wip so you can give me some feedback.
My process often varies, sometimes I do only one sketch for the pose and dynamic depending on your demand, sometimes I can give three and you pick your favorite. In the second case, be aware that the two sketches you haven’t chosen might be used for something else, be it adopts, a YCH or another commission. Of course, these sketches will only reflect the position of a generic horse, it won’t be your design in all its details that I re-use later on obviously !DESIGNSI will send the files (colored background + transparent one) after receiving payment on either Stash, ToyHouse or by mail, whatever works best for you.Please credit me as the original artist when sharing a design from me ! If you were to upload it on ToyHou.se, don’t forget to add me as the original designer as well, my TH is Mydajk. Most often I will transfer it myself on TH though.Once you buy a design from me, the character belongs to you. Thus you can change whatever you want (horn, wings, whatever) as long as the original design is somewhat recognizable and you don’t forget to still credit me as the original designer.
Please be aware that making some changes do not allow you to add monetary value to it because you customized it. Still my rules :)As written in the Copyright and Commercial Use sections, you are not allowed to take inspiration from my designs to create breedables, children or any other design.If you want to resell a design, please head over the Commercial Use > Specific cases section.
As for Howrse, see below.SIM GAMES AND HOWRSEI myself play on Howrse thus know how it works. For the record, the Creative Space on Howrse is considered commercial use ; keep in mind that by sending an artwork on Howrse, you give them the right to use said artwork for commercial purposes (not the character’s rights nor ownership, but the artwork’s commercial use). Copyrights can be tricky and I really want to make sure it’s fine for everyone involved thus I will go into detail below.As a general rule, I will never send a commission you bought from me on Howrse.
If I am not the designer of your character, under no circumstance a commission of it will end on Howrse, whether you ask me or not.
You cannot send any of my artworks on Howrse, be it a design by me or not.As for the specifics, if we both belong in the Howrse community :The main point is you need everyone’s approval to send it on Howrse : the owner, the designer and the artist (you, because if it’s someone else, you aren’t allowed to send it yourself on Howrse). It means :If I am the designer of your character and you ask me specifically to send my artwork on Howrse (because you’re a player and want to put it on your ponies or whatever), then we can discuss it.If I am not the designer of your character and through commissions or trades you ask me to send my artwork on Howrse, we can discuss it if the original designer of your character allows it in their T.O.S. and if we DM them to ask for permission. If they don’t allow commercial use and/or SIM games, it will be no without further discussion.If you play on Howrse and want to send on the Creative Space your drawing of your character you bought from me, show me and ask me first. Generally speaking, I’m OK with it, as long as it is your drawing, your character and you DM me to ask first. This is just to make sure that a random player doesn’t use your character you bought from me, draws it and sends it on Howrse without you even knowing.
If a friend of yours wants to draw your character and send it on Howrse, once again I am OK with it generally speaking as long as you are OK with it too and DM me to ask first.
You have to own the character I designed and redraw it yourself if you want to maybe see it on Howrse.
Do not hesitate to reach out to me in DM or on Howrse (Alektô, French Server) if you want to be sure you are allowed to send something on the Creative Space.My artworks cannot be used in any other SIM games outside of Howrse as I don’t know how they work and cannot control where it goes.I insist, read and reread this carefully, reach out to me in DMs if you need more explanations as copyright infringement can be complicated.If I see any of my artworks, be it a drawing by me or my design that someone redrew and sent without me knowing I will go berserk, meaning 1. contact the owner of said character to ask if they’re aware of their character being used for Howrse ; 2.
